KOTA KEDIRI โ Polemik perhitungan pelunasan dipercepat kembali menyeret nama perusahaan pembiayaan. Kali ini, seorang debitur resmi mengajukan Pengaduan Masyarakat (Dumas) ke Polresta Kediri terkait dugaan ketidaktransparanan perhitungan pelunasan yang diterapkan oleh WOM Finance.
Pelaporan tersebut dilakukan pada Kamis (18/6/2026) dengan pendampingan dari GRIB Jaya DPC Kota Kediri. Pengaduan diajukan oleh seorang debitur warga Kabupaten Kediri yang meminta aparat penegak <a href="https://mojopaitnews.com/tambang-ilegal-terus-bernapas-aparat-penegak-hukum-kehabisan-keberanian/”>hukum melakukan penyelidikan dan klarifikasi terhadap sistem perhitungan pelunasan dipercepat yang dinilai menimbulkan pertanyaan dan berpotensi merugikan konsumen.
Kasus ini bermula ketika pelapor memperoleh fasilitas pembiayaan dari WOM Finance sebesar Rp120 juta dengan jangka waktu pembiayaan selama 48 bulan.
Setelah berjalan kurang lebih empat bulan, pelapor telah membayar angsuran dengan total sekitar Rp15,98 juta. Namun saat berkeinginan melakukan pelunasan dipercepat, pelapor memperoleh informasi bahwa dirinya harus menyiapkan dana sekitar Rp130 juta untuk mengakhiri kontrak pembiayaan tersebut.
Besaran angka tersebut sontak memunculkan tanda tanya besar.
Bagaimana mungkin setelah melakukan pembayaran angsuran selama empat bulan, nilai pelunasan yang diminta justru mendekati bahkan melebihi jumlah dana yang diterima saat pencairan pembiayaan?
Pertanyaan itulah yang kemudian mendorong pelapor mencari penjelasan lebih lanjut dan akhirnya menempuh jalur pengaduan resmi.
Temuan dalam Dokumen Perjanjian
Berdasarkan dokumen perjanjian pembiayaan yang dimiliki pelapor, tercatat nilai objek pembiayaan sebesar Rp120 juta.
Namun di dalam kontrak juga tercantum Pokok Sewa Pembiayaan sebesar Rp132.279.540.
Dari penelusuran dokumen tersebut diketahui terdapat sejumlah komponen biaya yang dibebankan kepada konsumen, yakni biaya provisi sebesar Rp5.952.580, biaya asuransi sebesar Rp4.026.960, serta biaya administrasi sebesar Rp2.300.000.
Menariknya, apabila ketiga komponen tersebut dijumlahkan, nilainya mencapai Rp12.279.540 atau sama persis dengan selisih antara nilai pembiayaan Rp120 juta dan Pokok Sewa Pembiayaan sebesar Rp132.279.540.
Temuan ini kemudian memunculkan dugaan bahwa biaya provisi, biaya administrasi, dan premi asuransi turut dikapitalisasi ke dalam pokok pembiayaan yang menjadi dasar perhitungan kewajiban debitur.
Apabila benar demikian, maka muncul pertanyaan apakah konsumen tidak hanya membayar biaya-biaya tersebut, tetapi juga membayar keuntungan pembiayaan atas biaya tersebut selama masa kontrak berjalan.
Pertanyakan Dasar Perhitungan Rp130 Juta
Dalam pengaduan yang disampaikan ke Polresta Kediri, pelapor menyatakan hingga saat ini belum memperoleh penjelasan rinci mengenai sejumlah hal penting.
Di antaranya mengenai dasar perhitungan pelunasan dipercepat, rincian sisa pokok pembiayaan, dasar pengenaan penalti, status pengembalian premi asuransi yang belum digunakan, serta perhitungan matematis yang menghasilkan angka pelunasan sekitar Rp130 juta.
Pelapor menilai informasi tersebut merupakan hak konsumen yang wajib diberikan secara jelas dan transparan.
Sebelum menempuh jalur pengaduan, pelapor diketahui telah berupaya meminta penjelasan kepada pihak WOM Finance melalui somasi dan audiensi. Namun hingga laporan diajukan, persoalan tersebut belum memperoleh kejelasan yang dianggap memadai.
Aspek Perlindungan Konsumen
Kasus ini turut memunculkan pertanyaan mengenai penerapan prinsip transparansi dalam sektor jasa keuangan.
Dalam pengaduannya, pelapor mengacu pada Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen serta Peraturan Otoritas Jasa Keuangan (POJK) Nomor 22 Tahun 2023 tentang Pelindungan Konsumen dan Masyarakat di Sektor Jasa Keuangan.
Kedua regulasi tersebut menegaskan bahwa konsumen berhak memperoleh informasi yang benar, jelas, jujur, dan mudah dipahami mengenai produk maupun layanan jasa keuangan yang digunakannya.
Selain itu, aspek asuransi juga menjadi perhatian.
Dokumen pembiayaan menunjukkan adanya premi asuransi sebesar Rp4.026.960 untuk masa pembiayaan selama 48 bulan. Dengan kondisi kontrak yang baru berjalan sekitar empat bulan, muncul pertanyaan mengenai kemungkinan pengembalian premi atas masa pertanggungan yang belum digunakan serta bagaimana mekanisme pelaksanaannya.
Basuki: Konsumen Berhak Mengetahui Dasar Perhitungan
Ketua GRIB Jaya DPC Kota Kediri, Basuki, menegaskan bahwa pendampingan yang dilakukan organisasinya bukan bertujuan menghindarkan debitur dari kewajiban pembayaran.
Menurutnya, fokus utama yang diperjuangkan adalah hak konsumen untuk memperoleh informasi yang transparan dan dapat dipertanggungjawabkan.
“Kami tidak pernah mengajarkan masyarakat untuk menghindari kewajiban. Kalau memang ada sisa pokok pembiayaan dan ada penalti yang sah berdasarkan perjanjian, tentu harus dihormati. Namun konsumen juga berhak mengetahui secara rinci bagaimana angka tersebut dihitung,” ujar Basuki.
Ia menambahkan bahwa pelaporan ke Polresta Kediri dilakukan untuk memperoleh kepastian hukum dan memastikan tidak ada pihak yang dirugikan akibat kurangnya transparansi informasi.
“Setiap tagihan harus memiliki dasar yang jelas, dapat diverifikasi, dan dapat dijelaskan kepada konsumen secara terbuka. Ketika seluruh perhitungan dibuka secara transparan, maka tidak akan ada ruang bagi spekulasi maupun prasangka,” tegasnya.
Dedy Luqman Hakim: Transparansi Merupakan Kewajiban Hukum
Sementara itu, Wakil Kepala Bidang Hukum GRIB Jaya DPC Kota Kediri, Dedy Luqman Hakim, S.H., menilai bahwa persoalan yang dilaporkan debitur tidak hanya berkaitan dengan nominal pelunasan, tetapi juga menyangkut perlindungan hak-hak konsumen dalam memperoleh informasi yang jelas dan dapat dipertanggungjawabkan secara hukum.
Menurut Dedy, hubungan hukum antara perusahaan pembiayaan dan konsumen harus dilandasi prinsip keterbukaan, akuntabilitas, serta itikad baik sebagaimana diatur dalam berbagai regulasi perlindungan konsumen dan sektor jasa keuangan.
“Yang dipersoalkan dalam laporan ini bukan kewajiban membayar utang. Debitur tetap wajib memenuhi kewajibannya sesuai perjanjian yang telah disepakati. Namun perusahaan pembiayaan juga memiliki kewajiban hukum untuk menjelaskan secara rinci dasar perhitungan setiap tagihan yang dibebankan kepada konsumennya,” ujar Dedy.
Ia menjelaskan bahwa konsumen berhak mengetahui secara detail komponen yang membentuk nilai pelunasan, termasuk sisa pokok pembiayaan, bunga atau margin pembiayaan, biaya administrasi, biaya provisi, penalti, maupun status premi asuransi yang belum digunakan.
“Apabila terdapat biaya-biaya yang dikapitalisasi ke dalam pokok pembiayaan, maka konsumen berhak mengetahui konsekuensi perhitungannya. Jangan sampai konsumen hanya menerima angka akhir tanpa diberikan penjelasan matematis yang jelas dan dapat diverifikasi. Transparansi bukan sekadar etika bisnis, tetapi merupakan kewajiban hukum yang harus dipatuhi oleh setiap pelaku usaha jasa keuangan,” tegasnya.
Lebih lanjut, Dedy menegaskan bahwa langkah pelapor mengajukan Pengaduan Masyarakat merupakan hak konstitusional warga negara yang dijamin oleh hukum.
Menurutnya, pelaporan tersebut tidak boleh dimaknai sebagai bentuk penolakan terhadap kewajiban pembayaran, melainkan sebagai upaya mencari kejelasan dan kepastian hukum.
“Kami menghormati asas praduga tak bersalah dan tetap memberikan ruang kepada pihak WOM Finance untuk memberikan klarifikasi maupun hak jawab. Namun di sisi lain, konsumen juga memiliki hak yang sama untuk memperoleh penjelasan yang transparan atas setiap kewajiban finansial yang dibebankan kepadanya. Karena itu kami berharap proses penyelidikan dapat berjalan objektif, profesional, dan berdasarkan fakta-fakta hukum serta dokumen yang ada,” pungkas Dedy.
Menunggu Klarifikasi dan Hasil Penyelidikan
Pengaduan yang diajukan ke Polresta Kediri tersebut pada dasarnya meminta aparat melakukan penyelidikan dan klarifikasi guna memastikan apakah terdapat perbuatan yang bertentangan dengan ketentuan perundang-undangan yang berlaku serta berpotensi merugikan konsumen.
Kasus ini sekaligus menjadi ujian bagi komitmen industri pembiayaan dalam menerapkan prinsip transparansi, akuntabilitas, dan perlindungan konsumen sebagaimana diamanatkan regulasi sektor jasa keuangan.
Hingga berita ini diturunkan, pihak WOM Finance masih memiliki hak untuk memberikan klarifikasi, penjelasan, maupun hak jawab atas berbagai hal yang menjadi materi pengaduan tersebut.
